It was truly a privilege, because J.R.'s expertise and insight into the dynamics of an effective mediation are so extensive. His training was particularly enriching in that he dealt with conflict variables as well as human psychology/personality variables. I had time to role-play and receive insights to further hone my skills through the training. Sure. I am very interested in how our system here could be made more efficient, get more people to settlement faster and be less of a drain on court resources. From what I have heard, the approach you worked on in Texas is certainly an improvement over how we are doing things here. As we discussed I am here on the bench until at least the end of November, and I intend to try to participate in the discussion on how to improve our way of doing things here in the meantime from my perspective as a family court judge. I have done several of the ADR meditations recently and have observed first-hand the problems with the way it is handled here. There is clearly room for improvement.

Sorry for the delay in responding. Actually I am an Arizona Superior Court Judge in Phoenix. I hope to semi-retire in the not too distant future and I am preparing myself for the transition, which I hope will include a mediation practice. I am also on a family assignment that requires some mediation skills so I thought I should get a bit of additional training. I had some mediation training years ago and have mediated some over the years, mostly during the period that I was a pro tem settlement judge before I was appointed to the bench in 2004.

 

The reason I took your course is that I wanted to take the Advanced Mediation course given by the National Judicial College, but they require that you take a 40 hour basic certification mediation course before you can take their course. I did not want to take their basic course, which is in the $1500 (plus expenses) range so I looked for a less expensive alternative and found your course on line.


I am finally into the course. I have watched the ‘Is mediation for you?’ video and am now reading the manual.  I have an ipod touch and I may try to just download them directly onto that. I’d appreciate any suggestions you might have on the downloads.

 

So far I am finding the training manual and other materials to be good  and I hope to be able to figure out the other downloads. I hope to complete it this weekend or the end of next weekend (April 15th) at the latest, which I think is my deadline to get through the course (although I am little unclear on that).

I have not had an opportunity to meet you but I am extremely impressed with the materials that encompass your mediation program.  I wanted you to know my motivation in making this change in my practice of law so you will have some insight into me as your student. 

I am a 41 year old divorced father of 2 boys.  In 1999, I was diagnosed with chronic progressive Multiple Sclerosis.  I was told I would likely end up in a wheelchair by the end of 1999.  I am happy to report that I am no where near that.  However, I was advised that being a busy trial lawyer and the accompanying stress was not good for keeping the progression of the disease in check.  I decided I wanted to become a mediator.  My law partner and I bought a building in Mid town which was just completed this July. 

This turn of the century historical building is the perfect place to conduct mediations in a comfortable atmosphere for all involved.  I am very pleased to now be able to do that and thank you very much for the important part you have played in that and in your excellent materials which I will refer to for the rest of my practice.  Thank you again and best wishes.

Thank you for your kind words, and your guidance. I think that the primary problem I may have overlooked when I wrote the first statement was the fact that, when I practiced mediation for 15 years(this having been some years ago), I always dealt with corporate parties who were invariably represented by counsel.
 
They knew the process, and, over time, I shortened my opening statement because the attorneys had always briefed their clients on the process and, as a result, much of what I said was repetitious to them. I unconsciously fell back on my previous approach, which I fully recognize as having been inadequate in my first attempt here.

Thank you for including a copy of your own opening statement, which is a real masterpiece of succinct fact and reason.

I enjoyed the course.  The materials opened up nicely this whole new world of being a mediator.  It also did a good job of providing new skills that will be life changing, as it will not only help make me a good mediator, but also a better all around communicator. 

The response to my request for the test was very speedy and grading of the test and test results equally speedy.  I received the test within an hour or so on requesting it and after taking the test, received my test results the same day, just hours later, and received my e-mailed certificate the same evening as well, and this was all on a Sunday!  Very impressive. 

Finally, I am a person that prefers not to be in crowds, and enjoyed being able to absorb the materials on my own schedule.  I really appreciate the Basic Mediation Course being offered on-line.

I thought the exam was attached and obviously was not.  It worked much better in word than in acrobat.  I am very impressed with what you've done in putting the materials together.  I was very skeptical at first, and have come full circle.  How long did it take you to create all of the documents?
